This RV / Motorhome Rental Agreement (this "Agreement") is entered into by and between Robert and Linda Hartman ("Owner") and Daniel Okafor ("Renter"). Owner agrees to rent to Renter the vehicle/vessel described herein, subject to the terms and conditions set forth below. This Agreement is a lease of goods governed by Article 2A of the Uniform Commercial Code as enacted in the State of Florida (see UCC §§ 2A-101 et seq., adopted in every U.S. state except Louisiana), together with applicable federal and state motor-vehicle, recreational-vehicle, and vessel laws.
1.
RV / MOTORHOME DESCRIPTION
Owner agrees to rent the following rv / motorhome to Renter: 2023 Winnebago Travato 59K. VIN: WD4PF1CD0N3176423. Registration: FL-RV2291. Included equipment and accessories: Awning, outdoor BBQ, 2x folding chairs, camp table, solar panel, full propane tank, linens and towels, GPS unit. Pre-rental condition: Small chip on passenger mirror housing (pre-existing, noted in photos). All systems serviced Oct 2024.. Owner represents that the rv / motorhome is properly titled and registered with the State of Florida under applicable motor-vehicle and recreational-vehicle titling statutes.
2.
RENTAL PERIOD
The rental period shall commence on July 4, 2025, 09:00 AM and shall end on July 11, 2025, 09:00 AM. Pickup and return location: 742 Lakeview Dr, Naples, FL 34102 - 9:00 AM. Late returns may be subject to additional charges at the applicable rental rate plus any late fees.
3.
RENTAL RATE
Renter agrees to pay Owner a rental rate of $350.00 per day. Payment is due in full prior to or at the time of pickup unless otherwise agreed in writing.
4.
GEOGRAPHIC RESTRICTIONS
The rv / motorhome shall not be operated outside the following designated area: Florida only - no travel outside state lines. Operating the rv / motorhome outside the permitted area constitutes a material breach of this Agreement and may result in immediate termination and forfeiture of the security deposit.
5.
USAGE LIMITS
The rv / motorhome is subject to a daily mileage limit of 150 miles per day. Excess usage will be charged at $0.45 per mile.
6.
SECURITY DEPOSIT
Renter shall provide a security deposit of $1,500.00 prior to pickup. The deposit shall be refunded within fourteen (14) days of return, less deductions for damages, excessive cleaning, missing equipment, overage fees, or other charges as outlined in this Agreement.
7.
FUEL RETURN POLICY
Renter shall return the rv / motorhome with the fuel tank at the same level as at pickup (full tank). A fuel surcharge of $6.50 per gallon will be assessed for fuel shortages.
8.
WASTE TANK POLICY
Renter shall empty and flush all waste water tanks (black water and gray water) prior to returning the rv / motorhome. Failure to empty tanks will result in a service fee of $175.00.
9.
CLEANING
Renter shall return the rv / motorhome in reasonably clean condition. If excessive cleaning is required, a cleaning fee of $150.00 will be deducted from the security deposit.
10.
PET POLICY
No pets are permitted in or on the rv / motorhome at any time. Violation of this policy will result in forfeiture of the security deposit and additional cleaning charges.
11.
NO SMOKING
Smoking (including vaping and e-cigarettes) is strictly prohibited inside the rv / motorhome. Violation will result in forfeiture of the security deposit and a minimum cleaning fee of $250.
12.
WARRANTIES AND CONSUMER DISCLOSURES
Owner leases the rv / motorhome in the condition documented above. Any written manufacturer warranty transferred with the rv / motorhome is subject to the Magnuson-Moss Warranty Act, 15 U.S.C. §§ 2301 et seq. Except for any such written warranty and any non-waivable implied warranties of merchantability and fitness recognized under UCC §§ 2A-210 through 2A-216 as enacted in the State of Florida, the rv / motorhome is leased on an "as-is" basis to the fullest extent permitted by law. If this Agreement qualifies as a "consumer lease" within the meaning of UCC § 2A-103(e), Renter retains all non-waivable protections afforded consumer lessees under that Article.
13.
HOLD HARMLESS AND INDEMNIFICATION
To the fullest extent permitted by law, Renter agrees to indemnify, defend, and hold harmless Owner from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney fees) arising from Renter's use, operation, or possession of the rv / motorhome during the rental period. This includes, without limitation, personal injury, property damage, traffic and navigation-rule violations, and environmental contamination. Nothing herein purports to limit any liability that may not be disclaimed or indemnified under applicable law, including federal maritime liability principles governing vessels in navigable waters.
14.
ADDITIONAL TERMS
No driving after 10:00 PM. Vehicle must be returned with all equipment intact. No open flames inside vehicle.
15.
GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, including its enactment of UCC Article 2A and its motor-vehicle, recreational-vehicle, or vessel-registration statutes. To the extent this Agreement concerns a vessel operating in navigable waters of the United States, federal maritime law shall also apply as required by the U.S. Constitution and 28 U.S.C. § 1333. Any legal action arising under this Agreement shall be brought in a court of competent jurisdiction in the county where Owner resides, subject to any exclusive federal maritime jurisdiction.
16.
ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements. No amendment shall be effective unless in writing and signed by both parties.
