Cash-Transaction Reporting. Any person who receives more than $10,000 in cash in one transaction (or two or more related transactions) in the course of a trade or business must file IRS Form 8300 within 15 days under IRC §6050I and 31 U.S.C. §5331. Willful failure to file is a misdemeanor or felony (26 U.S.C. §§7203, 7206). Financial institutions separately file currency transaction reports under 31 U.S.C. §5313 and 31 C.F.R. §1010.311.
Tax Treatment. Amounts received are includible in gross income under IRC §61 and, where applicable, give rise to recognized gain under IRC §1001. Seller is responsible for collecting and remitting any applicable state sales tax.
Purpose. This receipt evidences payment for the purpose stated above; it is not, by itself, a contract and does not waive either party’s rights under the underlying agreement.
