This Pet Custody Agreement ("Agreement") is entered into on March 12, 2026 by and between Alex Morgan ("Party 1") and Jamie Chen ("Party 2"), collectively referred to as the "Parties." The Parties acknowledge that under the common law of most U.S. jurisdictions, domestic animals are categorized as personal property (chattel), and that courts have historically applied a property-law analysis to disputes over their ownership (see, e.g., Raymond v. Lachmann, 264 A.D.2d 340 (N.Y. App. Div. 1999)). A growing number of states have enacted statutes directing courts to consider the well-being of the animal in divorce and separation proceedings, including Alaska Stat. §25.24.160(a)(5) (2016), Illinois 750 ILCS 5/503(n) (2018), California Family Code §2605 (2019), New York Domestic Relations Law §236(B)(3)(f) (2021), and Rhode Island General Laws §15-5-16.1-1. The Parties enter into this Agreement in the spirit of those statutes and agree to the following terms regarding the custody, care, and financial responsibility for the pet described herein.

CUSTODY ARRANGEMENT
The Parties agree to a Joint Custody arrangement. Alex Morgan shall serve as the Primary Custodian. In jurisdictions that recognize pet-well-being statutes (e.g., Cal. Fam. Code §2605; 750 ILCS 5/503(n); N.Y. DRL §236(B)(3)(f)), this allocation is intended as the Parties' best-for-all-concerned determination. In jurisdictions applying traditional chattel rules, this allocation shall be construed as a contractual bailment arrangement governed by state bailment law.
Under joint custody, both Parties share equal responsibility for the pet's care and well-being during their respective custody periods.
2.
VISITATION AND SCHEDULE
Regular Schedule: Alternating weeks starting Monday at 6:00 PM. Party 1 has custody on odd-numbered weeks, Party 2 on even-numbered weeks.
Holiday Rotation: Thanksgiving with Party 1 in odd years, Party 2 in even years. Christmas Eve with Party 2, Christmas Day with Party 1, alternating annually.
Pickup/Drop-off Location: Laurelhurst Park main parking lot (SE 39th and Stark)
Transportation: Each party transports during their custody period.

EMERGENCY MEDICAL DECISIONS
Emergency medical decisions shall be made by: Primary Custodian decides. Either party may authorize emergency veterinary treatment up to $500 without prior consultation with the other party. Both Parties agree to notify the other party of any emergency veterinary visits within 24 hours.
4.
CARE STANDARDS
Living Conditions: Fenced yard access required. Indoor sleeping only. No crate confinement exceeding 4 hours.
Training and Discipline: Positive reinforcement methods only. No physical punishment. Continue weekly group obedience class at Portland Dog Academy.
Both Parties agree to maintain a safe, healthy, and nurturing environment for the pet at all times, consistent with the federal Animal Welfare Act (7 U.S.C. §§2131-2159) and applicable state anti-cruelty and licensing laws. Neither party shall neglect the pet's basic needs, including food, water, shelter, exercise, and veterinary care. The Parties further agree to maintain the pet's microchip registration and any required local licensing, and to exercise reasonable care to avoid liability under applicable state dog-bite or owner-responsibility statutes (e.g., Cal. Civ. Code §3342).
5.
RELOCATION
If either Party intends to relocate to a new residence, the following applies: 30 days written notice required. Relocation that materially affects the custody schedule or the pet's welfare shall require renegotiation of this Agreement in good faith.
6.
NEW PETS
Regarding the introduction of additional pets into either household: No restriction. Both Parties shall consider the temperament and well-being of the pet covered by this Agreement before introducing any new animals.
7.
DISPUTE RESOLUTION
Any disputes arising from this Agreement shall be resolved through Mediation in the State of Oregon. Both Parties agree to attempt informal resolution before pursuing formal proceedings.
8.
ADDITIONAL TERMS
Both parties agree to maintain Luna's current veterinarian (Dr. Sarah Walsh, Hawthorne Animal Clinic). Any change of vet requires mutual agreement. Luna's vaccination and health records shall be shared with both parties digitally.
9.
GENERAL PROVISIONS
(a) Entire Agreement: This Agreement constitutes the entire understanding between the Parties regarding the custody and care of the pet described herein.
(b) Governing Law: This Agreement shall be governed by the laws of the State of Oregon, including any applicable pet-well-being statute and, where incorporated into a premarital or marital property agreement, the Uniform Premarital and Marital Agreements Act (UPMAA) as adopted by that State.
(c) Severability: If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
(d) Amendment: This Agreement may only be modified by a written document signed by both Parties.
(e) Good Faith: Both Parties agree to act in good faith and in the best interest of the pet at all times.
