This Addendum to Lease Agreement (this "Addendum") is entered into as of September 1, 2025, by and between Patricia M. Hendricks ("Landlord") and Daniel and Sofia Reeves ("Tenant"), for the property located at 742 Elmwood Lane, Portland, OR 97201. This Addendum modifies the original Lease Agreement dated September 1, 2024 (term: September 1, 2024 through August 31, 2025) and converts the tenancy to a month-to-month arrangement. The parties agree as follows:
1.
MONTH-TO-MONTH TENANCY
Effective September 1, 2025, the fixed-term lease is hereby converted to a month-to-month tenancy. The tenancy will continue on a month-to-month basis until terminated by either party in accordance with this Addendum and applicable state law.
2.
MONTHLY RENT
Tenant agrees to pay a monthly rent of 1,875.00 USD, due on the 1st day of each month. Rent shall be paid to Landlord at 100 Oak Street, Portland, OR 97202 or by another method agreed upon in writing.
3.
NOTICE TO TERMINATE
Either party may terminate this month-to-month tenancy by providing written notice of at least 30 days prior to the intended termination date, provided that the notice period shall not be less than the minimum required under applicable state law. State minimums include: California Civil Code §1946.1 (30 days if tenant has resided in the unit less than one year; 60 days if one year or more, by landlord); New York Real Property Law §226-c (HSTPA 2019: 30 days if tenancy less than one year, 60 days one to two years, 90 days two or more years); Texas Property Code §91.001 (one month before the end of the current rental period); Florida Statutes §83.57 (15 days for month-to-month tenancies). Notice shall be delivered in person, by certified mail return receipt requested, or by another method permitted by state law. Tenant remains liable for rent through the end of the notice period. Landlord shall not retaliate against Tenant for exercising any legal right (see Cal. Civ. Code §1942.5; N.Y. Real Prop. Law §223-b).
4.
JUST CAUSE AND TENANT PROTECTIONS
Where the Property is located in a jurisdiction with just-cause eviction or rent-control requirements, Landlord's termination notice and any rent increase shall comply with those laws. These include, without limitation: California Civil Code §1946.2 (AB 1482 Tenant Protection Act - just-cause termination after 12 months of tenancy, with statutory exemptions); California Civil Code §1947.12 (AB 1482 annual rent-increase cap); Oregon Senate Bill 608 (codified at ORS 90.427 / 90.323 - statewide just-cause and rent cap); New York City Rent Stabilization Code §2522 and the Emergency Tenant Protection Act; New Jersey Anti-Eviction Act, N.J.S.A. §2A:18-61.1; and any local rent-control or just-cause ordinances. Nothing in this Addendum waives any right Tenant has under these laws.
5.
FAIR HOUSING AND MILITARY PROTECTIONS
Landlord shall not discriminate against Tenant on the basis of race, color, religion, national origin, sex (including sexual orientation and gender identity), familial status, or disability in violation of the federal Fair Housing Act, 42 U.S.C. §§3601-3619, or applicable state or local fair-housing laws. If Tenant is a servicemember within the meaning of the Servicemembers Civil Relief Act (SCRA), 50 U.S.C. §§3901 et seq., Tenant may terminate this tenancy upon receipt of qualifying military orders in accordance with 50 U.S.C. §3955 (lease termination for military service), by delivering written notice and a copy of the orders to Landlord.
6.
LATE FEES
A late fee of 75.00 USD shall be charged for rent received after the 5-day grace period following the due date.
7.
ADDITIONAL TERMS
Except as modified by this Addendum, all other terms and conditions of the original Lease Agreement remain in full force and effect. In the event of a conflict between this Addendum and the original Lease Agreement, this Addendum shall control.
8.
GOVERNING LAW
This Addendum shall be governed by and construed in accordance with the laws of the state in which the Property is located, including without limitation the statutes cited herein (Cal. Civ. Code §§1946.1, 1946.2, 1947.12, 1942.5; N.Y. Real Prop. Law §§226-c, 223-b; Tex. Prop. Code §91.001; Fla. Stat. §83.57), the Fair Housing Act, 42 U.S.C. §§3601-3619, and the Servicemembers Civil Relief Act, 50 U.S.C. §§3901 et seq. If any provision of this Addendum is held invalid or in conflict with applicable law, the remaining provisions shall remain in full force and effect.
