What Is a Reference Letter?

A reference letter — sometimes called a letter of recommendation, employer reference or character reference — is a written statement about a person’s professional or personal qualities provided to a third party, typically a prospective employer, landlord, educational institution or professional body.

In Ireland, there is no general legal obligation on an employer to provide a reference, but once a reference is given it must be fair, accurate and not misleading. A reference that is carelessly drafted and contains false or unfounded assertions can give rise to claims in defamation under the Defamation Act 2009, in negligent misstatement under the principle in Hedley Byrne & Co Ltd v Heller & Partners Ltd [1964] AC 465 (applied in Ireland), and under the Data Protection Act 2018 and GDPR if it processes personal data unlawfully.

A well-drafted reference letter states the writer’s relationship to the subject, the dates and capacity of the employment or relationship, and a balanced description of the subject’s duties, strengths and, where appropriate, areas for development. It should be factual, avoid unsupported opinions, and be written in good faith.

Defamation Act 2009

A reference that contains a false and damaging statement of fact can be defamatory under the Defamation Act 2009. The Act provides defences of truth and qualified privilege — the latter typically protects references given in good faith to a prospective employer — but careless or malicious statements lose that protection.

Negligent Misstatement

An employer who gives a careless reference that is relied upon by the recipient to their detriment may be liable in negligent misstatement. The Irish courts apply the Hedley Byrne principle and expect references to be written with reasonable care and skill, whether the writer is supporting or criticising the candidate.

Data Protection and GDPR

A reference contains personal data about the subject. Under the Data Protection Act 2018 and GDPR, it must be accurate and lawfully processed. The subject generally has the right to access the reference (Article 15 GDPR), subject to limited exemptions in Schedule 5 of the 2018 Act.

Equality and Non-Discrimination

References must not contain discriminatory content contrary to the Employment Equality Acts 1998–2015. Writing a reference should avoid references to protected characteristics (age, gender, disability, race, religion, sexual orientation, civil status, family status, membership of the Traveller community) except where directly relevant and lawful.
