What Is a Resignation Letter?

A resignation letter is a formal written notice from an employee to their employer confirming their intention to end the employment relationship. It records the date on which notice is given, the employee's final working day (calculated from the contractual or statutory notice period), and any requests relating to outstanding leave, final salary or the handover of responsibilities. Putting resignation in writing protects both the employee and the employer and eliminates ambiguity about when the employment relationship legally ends.

In Singapore, the Employment Act (Cap. 91) governs the resignation process for all covered employees. Under s 10, an employee who wishes to resign must give the notice period specified in their contract of employment. If the contract does not specify a notice period, the statutory minimums apply: 1 day for employees with less than 26 weeks' service; 1 week for 26 weeks to 2 years; 2 weeks for 2 to 5 years; and 4 weeks for 5 or more years. Under s 11, either party may elect to pay salary in lieu of notice at the gross rate of pay instead of serving the full notice period.

Singapore employees have additional statutory protections when resigning. Under Employment Act s 22, final salary must be paid within 3 working days of the last day of employment (if the employee resigns without notice with employer agreement on payment in lieu) or within 7 days of the end of the last salary period. Notice Period Rights — Employment Act s 10 & s 11

Under Employment Act s 10, both employer and employee are bound by the same notice period. If your contract specifies a notice period, you must serve that period or pay salary in lieu. If no notice period is specified, the statutory minimums apply based on length of service. Under s 11, you may request that your employer accept payment in lieu of notice — the employer is not obliged to agree, but if they do, your employment ends on the date of payment. Resigning without notice or payment in lieu (other than in cases of constructive dismissal) may expose you to a claim for salary in lieu by the employer.

Final Salary & Annual Leave Encashment

This arises when an employer unilaterally reduces salary, subjects an employee to harassment or creates an intolerable working environment. Employees who resign in these circumstances may still be entitled to pay in lieu and may bring a wrongful dismissal claim at the Employment Claims Tribunal (ECT) after first seeking mediation through the Tripartite Alliance for Dispute Management (TADM).
