A witness statement is a formal written document setting out the evidence that a witness can give about the facts of a case. It is used in both civil and criminal proceedings in England and Wales and must be verified by a statement of truth.
In civil proceedings, witness statements are governed by Part 32 of the Civil Procedure Rules and Practice Direction 32. The statement must be in the witness's own words, set out facts within the witness's personal knowledge, and follow a specific format including numbered paragraphs and a statement of truth.
Witness statements serve as the witness's evidence-in-chief at trial. This means the court reads the statement instead of the witness giving their full account orally. The witness will then be cross-examined on the contents of the statement.

Follow these steps to produce a compliant witness statement:
Note down everything you personally witnessed or know about the matter. Focus on facts, not opinions, and organise them chronologically.
Include the case heading, your full details, and number each paragraph. Refer to documents as exhibits (e.g. "Exhibit AB1").
The statement must be in your own language. Avoid legal jargon unless necessary. State clearly what you saw, heard, or did.
If any facts come from someone else or from documents rather than your direct knowledge, say so clearly and identify the source.
Sign the statement and include the prescribed statement of truth. Be aware that making a false statement of truth is contempt of court.

Every UK witness statement must be verified by a statement of truth. Making a false statement verified by a statement of truth without honest belief in its truth is contempt of court in the United Kingdom, punishable by a fine or imprisonment.
Witness statements in criminal cases in England and Wales follow different rules under the Criminal Procedure Rules and the Criminal Justice Act 1967. The format differs from civil witness statements, and the consequences of making a false statement include prosecution for perjury or perverting the course of justice.
