1.
PARTIES AND PURPOSE
This agreement is made on 2026-05-22 between David and Helen Carter (the "Landlord") and Sophie Chen (the "Tenant") in respect of the residential premises at 42 Maple Avenue, London E5 9BT (the "Property"). Its purpose is to document agreed variations to the existing Assured Periodic Tenancy of the Property, without ending the tenancy or attempting to create a new fixed term (which would be prohibited by section 1 of the Renters' Rights Act 2025 from 1 May 2026). Save as expressly varied, the terms of the original tenancy agreement (the "Original Tenancy") continue to apply.
2.
ORIGINAL TENANCY
The parties refer to the existing tenancy (the "Original Tenancy") of the Property, which commenced on 2025-04-01 and was originally expressed to expire on 2026-03-31. All obligations, warranties and covenants under the Original Tenancy remain binding except as expressly varied by this agreement.

EFFECTIVE DATE AND CONTINUATION
The variations recorded in this agreement take effect on 2026-06-01. The tenancy continues as an Assured Periodic Tenancy under the Housing Act 1988 as amended by the Renters' Rights Act 2025 and is not converted by these variations into a new tenancy or a fixed term. Either party may end the APT in accordance with statute (tenant: 2 months' written notice from day one; landlord: only on a Schedule 2 ground under s.8 HA 1988).

RENT
With effect from 2026-06-01, the rent payable by the Tenant shall be £1,300.00 per month, payable in advance on the 1st day of each month, without deduction, set-off or counterclaim (save as required by law). The previous rent under the Original Tenancy was £1,200.00 per month. Where this variation includes an increase to the rent, the parties acknowledge that the landlord's statutory route for rent increases on an APT is the Form 4A procedure under section 6 of the Renters' Rights Act 2025 (replacing the former s.13 Housing Act 1988 mechanism), restricted to one increase per 12-month period with at least two months' notice, and the tenant may challenge any proposed increase at the First-tier Tribunal under RRA 2025 s.7; no increase takes effect until the Tribunal has determined the market rent. A tenant-accepted variation recorded in this agreement does not waive those statutory rights. Rent is a "permitted payment" for the purposes of the Tenant Fees Act 2019.

CONTINUATION OF ORIGINAL TERMS
Save as expressly varied by this agreement, all terms, covenants, warranties and conditions of the Original Tenancy shall continue in full force and effect and shall apply to the new term / continuing APT as if repeated here in full. The Landlord's implied repairing obligations under section 11 of the Landlord and Tenant Act 1985 and the implied fitness-for-habitation covenant under section 9A of that Act and the Homes (Fitness for Human Habitation) Act 2018 continue unchanged. The Landlord remains subject to Awaab's Law (as extended to the private rented sector by the Renters' Rights Act 2025) and the extended Decent Homes Standard.
6.
DEPOSIT
The existing deposit shall continue to be held in accordance with sections 212-215 of the Housing Act 2004. The deposit is or shall be protected in Deposit Protection Service (DPS, custodial). The original protection continues without need for re-protection because this agreement varies the existing APT rather than creating a new tenancy; the parties refer to Superstrike Ltd v Rodrigues [2013] EWCA Civ 669 by analogy.
7.
RENT REVIEW BASIS
The revised rent has been set on the following basis: Adjustment in line with the local open-market rent for a comparable one-bedroom flat in the E5 area and CPI inflation over the preceding 12 months.. The Landlord confirms that the revised rent reflects an open-market rent for a comparable property and complies with the non-discrimination duties in the Equality Act 2010. Where this variation increases the rent it is set in conjunction with — and not in substitution for — the Form 4A procedure under RRA 2025 s.6.
8.
VARIED TERMS
With effect from 2026-06-01, the following terms of the Original Tenancy are hereby varied:

Clause 12 (Pets): the Tenant may keep one domestic cat at the Property.

Each variation has been assessed for fairness and transparency in accordance with Part 2 of the Consumer Rights Act 2015.
9.
UTILITIES AND SERVICE CHARGES
The parties agree the following arrangements in respect of utility bills and service charges from the effective date:

From the effective date the Tenant shall be responsible for all utility bills including broadband, council tax, water, gas and electricity.
10.
PETS
With effect from 2026-06-01, the Tenant is permitted to keep domestic animals at the Property, subject to reasonable conditions as to cleanliness, nuisance and damage. The Landlord's consent is consistent with the Landlord's duty under section 11 of the Renters' Rights Act 2025 to consider such requests reasonably.
11.
STATUTORY COMPLIANCE ON VARIATION
The Landlord confirms compliance with the following statutory duties on or before the effective date: (a) an in-date Gas Safety Record (CP12) under reg.36 of the Gas Safety (Installation and Use) Regulations 1998; (b) a valid Energy Performance Certificate (EPC) with at least an E rating under the Energy Efficiency (Private Rented Property) (England and Wales) Regulations 2015 (MEES); (c) an in-date Electrical Installation Condition Report (EICR) under the Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020; (d) working smoke alarms on each storey and CO alarms in every room with a fixed combustion appliance, under the Smoke and Carbon Monoxide Alarm (Amendment) Regulations 2022; (e) service on the Tenant of the current "How to Rent" guide; and (f) a right-to-rent check or valid follow-up under sections 20-37 of the Immigration Act 2014; the civil penalty since 13 February 2024 is up to £10,000 first / £20,000 repeat per occupier (SI 2023/1305).

ADDITIONAL CONDITIONS
The Landlord agrees to redecorate the living room on or before 1 July 2026.
13.
RENTERS' RIGHTS ACT 2025 — STATUTORY CONFIRMATIONS
No new fixed term: the Landlord confirms that this agreement does not purport to grant a new fixed-term assured tenancy in England after 1 May 2026, which would be prohibited by section 1 of the Renters' Rights Act 2025. The tenancy continues as an APT.

Form 4A path: where the variation includes a rent increase, the Landlord will serve a Form 4A under RRA 2025 s.6 for the next applicable review cycle, and any disagreement may be referred to the First-tier Tribunal under RRA 2025 s.7.

Information Sheet: the Landlord has supplied the government Renters' Rights Act 2025 information sheet.

Ombudsman / Database: on commencement of the PRS ombudsman scheme and database under RRA 2025 the Landlord shall register and the Tenant shall thereafter be entitled to refer unresolved complaints.

Data handling: the Landlord processes the Tenant's personal data in accordance with the Data Protection Act 2018 as amended by the Data (Use and Access) Act 2025 (SI 2026/82 in force 5 February 2026) and the UK GDPR. The Landlord shall provide the Tenant with the Landlord's privacy notice and shall delete personal data within 6 years of the end of the tenancy.
14.
GOVERNING LAW AND JURISDICTION
This agreement is governed by and construed in accordance with the law of England and Wales. Any dispute arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales (County Court / First-tier Tribunal (Property Chamber)).
By signing below, the parties acknowledge that they have read, understood and agreed to the terms of this APT Variation Agreement and that it forms a binding contract.

Deposit Protection on Renewal

If the UK deposit from the original tenancy remains protected, it generally does not need to be re-protected for a renewal in England and Wales. However, some British schemes require the landlord to update the protection details and re-serve the prescribed information. Check with your UK scheme to confirm requirements.

Prescribed Documents

When renewing a UK tenancy, the British landlord should ensure the tenant has the most recent version of the How to Rent guide (which is updated periodically by the UK government), a valid and current gas safety certificate, and a valid EPC. Providing these at renewal in England and Wales ensures compliance for any future Section 21 notice under English law.

Rent Increases on Renewal

A rent increase agreed as part of a UK renewal is a contractual variation by mutual consent and does not require a Section 13 notice under English law. The new rent should be clearly stated in the British renewal agreement. The UK Tenant Fees Act 2019 does not prohibit rent increases in England and Wales, only prohibited fees.

Guarantor Position

If the original UK tenancy had a British guarantor, the renewal may release the guarantor from future liability in England and Wales unless the guarantee agreement expressly covers renewals. Consider obtaining the guarantor written consent to the renewal or having them sign a new guarantee under English law.
